By booking a session, submitting payment, joining a program or using our services, you agree to the following Terms & Conditions.
1. Overview
These Terms & Conditions apply to all services provided by The Social Brand (“we”, “us”, “our”) to any client (“you”, “your”).
We provide guided podcast recording, strategic storytelling, pre-production preparation, and content creation services.
2. Bookings & Acceptance
Your booking is confirmed once payment has been received.
By making a booking, you acknowledge that:

You have read, understood and agreed to these Terms

You are authorised to enter into this agreement
-
All communication will occur via email or SMS
We reserve the right to decline or discontinue services where required.
3. Services Provided
We provide:
-
Pre-strategy sessions (storytelling, brand direction, body language, confidence, authority, question planning)
-
Guided podcast recording
-
Short-form reels and edited content
-
Full episode audio/video files
-
Digital delivery via Google Drive or Dropbox
We do not provide:
-
Social media posting or management
-
Teleprompter scripts or full scripted interviews
-
Ongoing content distribution
4. Pre-Strategy Requirements
To ensure the best possible outcome:
-
All pre-strategy forms, questionnaires, and requested materials must be completed at least 72 hours before your session
-
Late completion may reduce the quality or depth of your final content
-
We are not liable for reduced quality, missed direction, or limited storytelling outcomes caused by incomplete preparation
If you request to cancel or reschedule within 72 hours — for any reason — your session is not forfeited, however a AUD $500 late-scheduling fee applies.
This must be paid before your new session date is confirmed.
5. Payment Terms
5.1 The Story Feature — Once-Off Session

A 50% deposit is required to secure your booking
-
Final payment is due 14 days prior to the recording date
-
If you book within 14 days of recording, full payment is required at booking
Late Payments & Session Cancellation
-
If final payment is not received 5 days prior, your session will be cancelled
-
A AUD $500 scheduling fee applies to reschedule after cancellation
5.2 The Influence Program — 6-Month Program
-
First month’s payment is due upon joining
-
All future monthly payments are processed automatically via our direct debit provider
-
Processing fees may apply
-
This is a strict 6-month commitment
-
The program cannot be paused, cancelled or refunded
-
Missed payments may result in suspension of services until resolved
6. Cancellations & Rescheduling — Story Feature
-
More than 14 days before recording:
-
No refunds apply
-
You may transfer to another date
-
If the new date selected falls within 14 days, a AUD $500 transfer fee applies
-

Within 14 days of recording:
-
Any change, cancellation or reschedule will incur a AUD $500 scheduling fee
-
-
No-shows:
-
Failure to attend without notice results in full forfeiture of the session Fee
-
7. The Influence Program — Attendance & Banked Sessions
-
The program is a minimum 6-month commitment
-
Missed sessions become banked sessions
-
Banked sessions must be used within 6 months after the program ends
-
Any unused sessions after this period will expire
Strategic Disclaimer
Delays, missed sessions or long gaps between recordings may alter:
-
narrative flow
-
brand cohesion
-
content sequencing
-
personal branding direction
-
intended strategy outcomes
We are not responsible for any disruption to your strategic outcomes caused by missed or delayed sessions.
Realignment strategy sessions may be required at an additional cost.
8. Editing & Revisions
For short-form reels:
-
Each reel includes up to three (3) revisions
-
Additional revisions are AUD $100 per edit
-
Revision requests must remain within the original agreed scope
-
Major creative changes require a new agreement
9. Intellectual Property & Usage
9.1 Joint Ownership of Content
The following content is jointly owned by The Social Brand, the client, and the recording studio:
-
Raw footage
-
Reels
-
Full episode recordings
-
Edited videos
-
Audio files
-
Transcripts
9.2 Usage by The Social Brand
By booking, you grant us a perpetual, royalty-free licence to use your content for:
-
promotions
-
marketing
-
advertising
-
portfolio display
-
social media
-
case studies
9.3 Our Intellectual Property
All proprietary frameworks, including the Six Pillars of Social Influence, remain the exclusive property of The Social Brand and cannot be reproduced, copied or repurposed.
10. Client Responsibilities
You are responsible for:
-
All statements made on camera
-
Ensuring the accuracy of your claims
-
Obtaining permission for any third-party brands, logos, images or trademarks referenced
-
Compliance with relevant laws
-
Conduct of any guests you bring
We are not responsible for:
-
defamatory or misleading statements
-
reputational outcomes
-
legal action arising from your content
-
backlash or public comments
-
IP breaches committed by you or your guests
11. Indemnity
You agree to indemnify and hold harmless The Social Brand against any claim, liability, loss, cost, damage, penalty or legal expense arising from:
-
statements made by you or your guests
-
defamation or misleading content
-
intellectual property breaches
-
breaches of these Terms
-
complaints made by third parties
This indemnity continues after services end.
12. Delivery & File Retention
-
Deliverables are provided digitally via Google Drive or Dropbox
-
Standard formats include MP4, WAV, MP3
-
We are not responsible for any compatibility issues with your systems
-
Raw files are stored for 12 months, then deleted permanently
13. Music & Media Licensing
-
Music used in reels is licensed for social media use only
-
Additional licensing is required for use in ads, websites or paid promotions
-
You are responsible for obtaining additional licences where needed
14. Technical Issues & Studio Liability
-
We are not liable for equipment malfunctions, corrupted files, power outages or studio disruptions
-
Re-recording may be offered at our discretion
Overtime
If your session runs beyond the allocated booking time, overtime fees may apply, charged at the rate set by the recording studio.
Damage
You are fully responsible for:
-
any damage you or your guests cause to studio equipment
-
damage to the facility or property
-
repair or replacement costs determined by the studio
We are not liable for injuries, accidents or hazards occurring within the studio.
15. Travel & Accommodation
For sessions requiring travel outside Melbourne:
-
Additional Fees apply for travel, accommodation and studio hire
-
These Fees must be paid prior to recording
16. Confidentiality
Both parties must keep all sensitive and private information confidential unless legally required to disclose it.
17. Force Majeure
We are not responsible for delays or cancellations caused by factors outside our control, including illness, natural disasters, government restrictions, or technical failures.
18. Governing Law
These Terms & Conditions are governed by the laws of Victoria, Australia.
19. Acceptance
By booking, submitting payment, attending a session or joining a program, you agree to these Terms & Conditions in full.
